Contract<\/h2>\n

De rechten die je zal genieten als distributeur hangen in essentie af van twee zaken:<\/p>\n

    \n
  1. Het distributiecontract:<\/strong> wat staat daarin precies gestipuleerd? Dit is in principe bindend voor beide partijen.<\/li>\n
  2. De juridische kwalificatie<\/strong> van de distributieactiviteit, ongeacht hoe jouw samenwerking werd benoemd in het contract. De rechter kan en zal immers een eigen kwalificatie kleven op de samenwerkingsvorm.<\/li>\n<\/ol>\n

     <\/p>\n

    Belgische wet<\/h2>\n

    In Belgi\u00eb is het zo dat twee type distributeurs extra beschermd worden door de wetgeving in geval van contractbe\u00ebindiging door de producent. Dit weliswaar enkel voor zover zij niet uit het netwerk worden gezet omwille van een grove fout:<\/p>\n

      \n
    • Concessiehouders<\/strong> genieten de meest verregaande bescherming bij de be\u00ebindiging van het distributiecontract door de fabrikant. Deze verdelers kunnen in theorie genieten van een \u2018redelijke\u2019 opzegtermijn of \u2013 vergoeding. Daarnaast kunnen zij ook aanspraak maken op een billijke bijkomende vergoeding voor aangebracht cli\u00ebnteel, gemaakte investeringen en te ontslagen personeel.<\/li>\n<\/ul>\n

      Voorbeeld<\/u>: <\/strong>Als je 15 jaar actief bent geweest als verdeler, levert je dat naar schatting 12 maanden opzegvergoeding op pl\u00fas nog een bijkomende vergoeding.<\/p>\n

        \n
      • Handelsagenten<\/strong> worden ook wettelijk beschermd, hetzij iets minder verregaand. Zij kunnen in theorie genieten van maximaal 6 maanden opzegtermijn of -vergoeding, een uitwinningsvergoeding (voor aanbreng en uitbreiding cli\u00ebnteel) en een bijkomende vergoeding voor eventuele resterende schade.<\/li>\n<\/ul>\n
